End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal contract between you ("User" or "You") and Helixfjord, the developer of the HelixTrack application ("Software" or "Application"). By downloading, installing, or using the Software, You agree to be bound by the terms of this Agreement. If You do not agree, do not install or use the Software.

1. License Grant

• License: Helixfjord grants You a limited, non-exclusive, non-transferable, revocable license to use the Software for personal or business purposes in accordance with this Agreement.
• Scope: This license is for the use of the Software only and does not convey ownership or any rights to the underlying intellectual property.

2. Restrictions

• Prohibited Actions:
• You may not reverse engineer, decompile, or disassemble the Software.
• You may not rent, lease, or sublicense the Software to others.
• You may not copy, distribute, or create derivative works of the Software without written consent.
• Compliance: You agree to use the Software in compliance with all applicable laws and regulations.

3. Ownership

The Software, including its content, features, and functionality, is the exclusive property of Helixfjord and is protected by copyright, trademark, and other intellectual property laws.

4. Updates and Modifications

• Updates: Helixfjord may provide updates, upgrades, or patches to the Software. Such updates are subject to the terms of this Agreement unless accompanied by a separate agreement.
• Modifications: Helixfjord reserves the right to modify or discontinue the Software at any time without notice.

5. Privacy and Data Usage

• Data Collection: The Software may collect and process geolocation data to provide its intended functionality. By using the Software, You consent to the collection and use of such data as outlined in our Privacy Policy.
• Data Security: Helixfjord employs reasonable measures to secure Your data but cannot guarantee complete security.

6. Disclaimer of Warranties

• As-Is Basis: The Software is provided "as is" and "as available" without warranties of any kind, either express or implied.
• Limitation of Liability: Helixfjord will not be liable for any damages, including loss of data, profits, or other losses, arising from the use or inability to use the Software.

7. Termination

• Termination by Helixfjord: This Agreement will terminate immediately if You violate its terms. Upon termination, You must cease all use of the Software and delete all copies.
• Survival: Sections relating to ownership, disclaimers, and limitations of liability will survive termination.

8. Governing Law

This Agreement is governed by and construed in accordance with the laws of [Insert Jurisdiction]. Any disputes arising from this Agreement will be resolved in the courts of [Insert Jurisdiction].
